Designing Early Eligibility Provisions in the wake of SECURE/SECURE 2.0’s LTPT rules & Mandatory Automatic Enrollment for new plans.

One of the more significant provisions of SECURE and SECURE 2.0 is theLong-term Part-time (LTPT) employee rules. The new provision will impact plan design, coverage, administration,  vesting, eligibility, top heavy and more.

In this session, we will discuss how different eligibility and exclusion provisions are affected by the LTPT rules.

The other significant change made by SECURE 2.0 was the requirement that 401(k) plans established after December 28, 2022 (with some exceptions) must include automatic enrollment in 2025.

Since the provision will require coordination between the employer, employees, payroll companies and  administrators, practitioners need to begin now to determine how to implement this new requirement

Speaker: Stephen Forbes, J.D. LLM

Stephen is an ERISA attorney and educator with 35 years of experience practicing and teaching in the retirement plan area. Recently, he received ASPPA’s 2019 Educators Award. Stephen was vice president of SunGard in charge of Relius Education. He teaches seminars, conferences and webcasts on retirement plan compliance, design and correction. He also provides professional consulting. Stephen has drafted qualified plan, 403(b), 457(b), 409A and IRA documents. He was the author of “The Form 5500 Filing Guide” and the co-author of “The Pension Library.” Stephen was a Tax Law Specialist at the IRS National Office (Employee Plans Division) where he trained IRS employees, wrote IRS Notices and Revenue Rulings and participated in several Treasury regulations committees.
