ASPPA’s 2018 Winter Virtual Conference, scheduled for Thursday, December 6th, promises to once again offer an efficient and cost-effective way to stay up-to-date with the latest developments affecting qualified retirement plans.  The 2018 Winter Virtual Conference will once again bring together some of ASPPA’s most highly rated speakers, namely:   Bob Kaplan, Director of Technical Education; and Craig Hoffman, General Counsel, American Retirement Association; Ilene Ferenczy, Managing Partner of the Ferenczy Benefits Law Center; and S. Derrin Watson, of the Law Offices of S. Derrin Watson.  The agenda will focus on some of the most important issues faced by pension professionals.  Each session will be led by one our experts, however, our other speakers will participate in the discussion to broaden the coverage of each topic.  And attendees will be able to submit questions throughout the day, which will be covered, as time permits, either as part of the relevant session or by the concluding “Ask the Experts” panel.

Developments in Washington continue to have a significant impact on retirement plans.  Changes to the 401(k) rules made by last year’s tax bill and this year’s budget bill will leave questions to be answered by IRS guidance.  A number of proposals have been introduced in Congress to enhance savings and increase coverage.  Take this opportunity to learn about current legislative and regulatory initiatives emanating from our nation’s capital.  Attendees will:

  • Get an update on the latest changes to the 401(k) laws
  • Hear what is lurking on the legislative horizon with regard to retirement plans
  • Get prepared for forthcoming changes in the regulatory landscape

Session 2:  Hot Topics in 401(k) Plans

Statutory changes from the TCJA of 2017 and the Budget Bill in 2018 have led to changes in the operation of 401(k) plans, particularly for loans and distributions.  This session will cover the impact in plan design and operation due to those changes, as well as other late-breaking developments that affect plans.  You will also learn about the latest trends in plan design, such as automatic enrollment, increase, and investing provisions. Attendees will:

  • Determine new sources for hardship distributions and when they are effective
  • Be updated on industry trends on the use of automatic plan provisions
  • Get the latest guidance from the IRS and DoL that impact plan operations

Session 3:  Ethics:  Dos and Don’ts for Those Administering Plans!

ASPPA members, like many other professionals, are subject to ethical standards.  This session will give an overview of the ASPPA Code of Ethics and how it relates to Circular 230.  In addition, case studies will be reviewed with real-life scenarios to demonstrate how ethical standards are met.  Attendees will:

  • Receive an overview of ASPPA’s ethics requirements and standards
  • Find out what practitioners need to know about Circular 230
  • Through case studies benefit from real-life scenarios that raise ethical concerns and learn how to deal with similar situations should they arise in your practice

Cross-tested plans are popular and effective tools to flexibly accomplish employer goals.  But some situations raise special challenges.  This presentation will cover such topics as cross-tested plans in a controlled group environment, strategies to avoid minimum gateway contributions, component plan testing, and how to handle circumstances when your well-laid plans blow up in your face. Attendees will:

  • Correctly perform cross-testing calculations in related employer situations
  • Employ creative strategies for situations that fall outside the norm
  • Apply alternative approaches in plan design
