PBGC Further Extends Hurricane Relief

The Pension Benefit Guaranty Corporation (PBGC) announced on Sept. 29 that it has extended the hurricane relief that it announced on Sept. 12 for victims of Hurricane Irma.

In Disaster Relief Announcement Number 17-16 the PBGC said that it is waiving certain penalties and extending certain deadlines in response to Hurricane Irma to the Seminole Tribe in Florida and its associated lands. The Seminole Tribe in Florida is a federally recognized Seminole entity in Florida that has six reservations in the state.

The PBGC says that the Seminole Tribe in Florida is among the designated persons covered by the relief it already outlined for victims of Hurricane Irma. A “Designated Person” is any person responsible for meeting a PBGC deadline (e.g., a plan administrator or contributing sponsor) that is located in the disaster area for which the IRS has provided relief in FL-2017-06, in connection with filing extensions for Form 5500 series returns, or that cannot reasonably obtain information or other assistance needed to meet the deadline from a service provider, bank or other person whose operations are directly affected by the Hurricane Irma in the Seminole Tribe of Florida.

The relief generally extends from Sept. 4, 2017 through Jan. 31, 2018.
