Hearing Set for EBSA Nominee

The Senate Health, Education Labor & Pensions (HELP) Committee will hold a hearing Nov. 15 on several nominations, including a new potential Assistant Secretary of Labor, Employee Benefits Security Administration.

On that date, the committee will question Preston Rutledge, President Trump’s candidate to head the EBSA, who was nominated last month.

Rutledge currently serves as senior tax and benefits counsel on the Majority Tax Staff of the U.S. Senate Finance Committee, where his responsibilities include employee benefits, retirement issues, tax-exempt organizations, health tax issues and the tax provisions of the Affordable Care Act. Previously he served as a senior tax law specialist on the headquarters staff of the IRS’ Tax Exempt and Government Entities Division and as a senior technical reviewer in the Qualified Pension Plans Branch of the IRS Office of Chief Counsel.

Among the candidates the hearing is also slated to include is Kate O’Scannlain, nominee for the DOL’s solicitor. O’Scannlain is a partner at global management firm Kirkland & Ellis focusing on labor and employment law aspects of corporate transactions and private equity.

If confirmed, the two would join the DOL as the agency is reviewing several major regulations issued under the Obama administration.
