Session 1 - Washington Update: Definition of Fiduciary, Proposed Regulations, and PTEs

Developments in Washington continue to have a profound impact on the design and administration of retirement plans. The DOL and IRS have promulgated expansive regulatory agendas, which include a number of items that will significantly impact qualified retirement plans. The newly seated Congress is expected to once again turn its attention to tax reform, which could be one of the few areas where a bipartisan agreement may be reached. Several proposals from President Obama would dramatically reduce the tax incentives that spur many small business owners to establish and maintain qualified retirement plans. Learn about how a new Congress will influence these proposals and how ASPPA’s Government Affairs Committee is responding.

Session learning objectives include:

  • Understand the potential for comprehensive tax reform and its impact on the private retirement system, now or in the future.
  • Understand the political climate in Washington and how it will affect legislative initiatives relating to retirement plans.
  • Learn about the IRS and DOL regulatory initiatives that will affect qualified retirement plans.

New correction techniques for safe harbor plan notice failures and automatic enrollment errors are expected at any moment from the IRS and will be covered if released prior to the program.

Session 3 - Mergers and Acquisitions: How to Turn Benefits Mayhem into Magnificent

When one company acquires another, the benefit ramifications are extensive and the HR departments of both the buyer and seller are commonly thrown into a whirlwind as a result. Many of the problems arise from a lack of experience with M&A benefits issues on the part of both companies, as well as a lack of preparation for the changes that must take place. Is there a partial plan termination? Who knows? However, with proper information flow, planning and creativity, the M&A process can be controlled and productive and partial plan terminations can be managed. Learn how things can go wrong…and how they can go right.

Session learning objectives include:

  • Recognize plan problem areas that arise when companies merge.
  • Learn ways to minimize potential risks to buyers and sellers.
  • Understand the benefits of merger management.

Plan Administrators are faced with a constant barrage of loan requests, hardship withdrawal requests and QDROs. Some of these requests might be creative and not meet the standards of the law and regulations. This session will review some of the more advanced situations and the rules associated with them.
