As health care reform and the “pay or play” rules comes into effect, it becomes even more important for employers to know who their employees are. In this session Derrin Watson will provide guidance on how to identify the differences between independent contractors and common law employees. He will also provide guidance on how to address the legal challenges presented by having leased employees.

      The webcast is designed to offer registrants 2 ASPPA CE credits.

      Enrolled Actuaries

      The webcast is designed to offer registrants 2 JBEA Non-Core CE credits for Enrolled Actuaries. The final decision as to the number and type of JBEA credits rests solely with the Joint Board for the Enrollment of Actuaries.

      Enrolled Retirement Plan Agent (ERPA)

      The webcast is designed to offer registrants 2 ERPA CE credits. The final decision as to the number of ERPA credits rests solely with the Internal Revenue Service.

      Continuing Education Changes for LIVE Webcast Attendees

      Each registered purchaser will be recorded when they log in to the live webcast with their name and email address. Purchasers will be awarded CE credits based on the amount of time the webcast was accessed. CE credits will be applied to their record on a periodic basis and a certificate of attendance will be emailed.

      Continuing Education Changes for RECORDED Webcast Attendees

      Once registered, attendees will receive a confirmation letter directing them to the “Access Recorded Webcasts” page with a link to the WebEx OnDemand Center. Each registered viewer will be tracked when they log in with their name and email address. The webcast link will expire once the attendee has satisfied the CE requirement. CE credits will be applied to their record on a periodic basis and a certificate of attendance will be available on each attendee's My ASPPA page.

      ABOUT THE SPEAKER

      S. Derrin Watson

      Derrin received his bachelor’s degree in accounting from BYU. In 1980, he graduated from UCLA Law School. Formerly the tax partner of a Beverly Hills law firm, he now works for SunGard with their Relius line of educational programs and products. He spends much of the year traveling to present seminars, and he prepares and delivers roughly 30 webcasts per year on a variety of pension topics.

       

      He has been involved with qualified plans since 1977 and had his first case involving controlled groups shortly thereafter. He has maintained a strong interest in this area ever since and has become the leading authority on controlled group, affiliated service group, and leased employee issues. He authored the first edition of Who’s the Employer in 1998, and just completed the 6th edition. He lectures frequently for ASPPA.  

      Derrin is a Senior Editor of the Journal of Pension Benefits and has authored the “Who’s the Employer” column on the BenefitsLink web site. He has a wife, two sons and three cats. His varied experiences range from doing standup comedy (yes, even about ERISA) to serving as a Mormon missionary in Iran, to editing and writing books and newsletters on a variety of topics. He directs his church choir and enjoys punctuating his ERISA presentations with original parodies.
